Today Transcarpathian Regional Administrative Court ordered to suspend the decision of the Regional Council dd. November 4, 2011 "On approval of the application of the "Maramorosh" LLC. The appropriate administrative claim for annulment of the Regional Council decision was filed to the court by the head of the initiative group of the Kosivska Polyana village community in Rakhiv district, a village council member Vasylyna Vetukhova.
Transcarpathian Regional Council in turn appealed to the Transcarpathian Regional Administrative Court to uphold the administrative claim in full, supporting the community of Kosivska Polyana. In particular, the statement says that the regional council by its decision approved the application of the "Maramorosh" Limited Liability Company to grant a special permit for geological study, including research and commercial development of polymetallic ore in the "Havryshuk" area, subject to the approval of land users, Rakhiv City Council, Kosivska Polyana village council and Kobyletska-Polyana village council.
"However, according to available information, including that published in the media, the "Maramorosh" LLC is mining ores without approvals of the village councils, which was an essential condition of approval of the Regional Council. We believe that due to the lack of approvals of the saud local authorities, the company has no legal basis to carry out any activity on the territory," – the statement of the regional council to the court says.
