The castle has been granted the status of a monument of architecture

As we reported, today, on July 18, the Court of Appeal of Transcarpathian region upheld the Prosecutor’s Office’s complaint, in particular, canceled the decision of the court of first instance, whereby Nevytsky Castle was transferred to Kamyanytsya village council and was recognized as ownerless property.

The consequence of the illegal court decision was the subsequent registration of the Nevytsky castle as a non-residential building.

The Court of Appeal agreed with the prosecutor’s office that Nevytsky castle, the fortress of the 14th century, is an architectural monument of national significance. And by virtue of the law, rights of ownership, use or management for monuments of architecture cannot be transferred without the consent of the appropriate body for cultural heritage protection.

In addition, at the court hearing, the prosecutor proved that in 2009, Nevytsky Castle, as a monument of architecture, was included in the List of objects of joint ownership of territorial communities, so at the time the court of the first instance made the decision, it was not ownerless property.

Thus, the panel of judges after listening to the arguments of the parties, upheld the appeal of the prosecutor’s office, revoked the decision of Uzhgorod city and district court and left the application of the Kamyanytsya village council without consideration, thus granting the fortress of the XIV century the status of a monument of national significance, the Transcarpathian Prosecutor’s Office informed on its website.
