Shokin “did not find” evidence of illegal purchase of the “Zakarpattyaoblenergo”

Kyiv Economic Court dismissed the action of the Prosecutor General to invalidate the sale of 50% of the "Zakarpattyaoblenergo" PJSC.

This is evidenced by the decision of Kyiv Economic Court dd. May 19, the "Nashi Hroshi" inform.

As noted, the prosecutors claimed that the Cabinet had improperly set additional conditions for the tender that were contrary to the law on privatization of state property resulting in a limited number of potential bidders.

Non-competitive conditions led to inefficient tender with low unprofitable for the state increase of the selling price of shares from the starting price of UAH 135 million only to UAH 140.7 million.

On May 12, the prosecutor was obliged to provide the court with documentary evidence to confirm the possibility of obtaining a more favorable price for the sale of shares of the "Zakarpattyaoblenergo" PJSC. But the evidence had not been submitted. Therefore, the court could not consider the claim and left it without consideration 

Recall that the Prosecutor General’s Office appealed to the court with this claim on April 3. Also, the GPO also filed similar claims to recognize unlawful the disposal of the state shares of the "Dniproenergo" and the "Donbasenergo."

At the same time, the privatization of the "Zakarpattyaoblenergo" is challenged by the investment company "Business-Invest" from the "Privat" group of Igor Kolomoisky. Currently, the "Business-Invest" has lost the first instance and the appeal.

Recall that in 2012, 50% of the "Zakarpattyaoblenergo" was purchased by the "Energy Ukraine TV" LLC of Igor Tynny, a business partner of Ivan Fursin related to the former head of the Presidential Administration Serhiy Lyovochkin. 

The investment company "Business-Invest" states that tenders for shares were held with violations. In particular, the Cabinet agreed the conditions of the auction that prevented the "Business-Invest" from taking part in them.
