Instead of at least 7 years in prison, a woman was sentenced to suspended term

Lawyer Victor Mashyka was defending in court Maria V. (name changed for ethical reasons) who was accused of committing a crime under Part 5 of Art. 185 of the Criminal Code of Ukraine (theft committed in large scale or by an organized group). This crime is punishable by imprisonment for a term of seven to twelve years with confiscation of property.

Since every detained person is entitled to protection by the state, the Regional center of free secondary legal aid in Transcarpathian region employed Victor Mashyka to provide free secondary legal aid to Mrs. Maria.  The defendant committed the crime being a minor, back in 2009. Previously not convicted, she was characterized positively, acknowledged the guilt to the crime, repented sincerely and facilitated the detection of the crime (extenuating circumstances). In addition, there were no aggravating circumstances.

Thus, Uzhgorod City and District Court of Transcarpathian region, applying Article 69 of the Criminal Code of Ukraine (appointment of a milder punishment than provided by law) and Art.75 of the Criminal Code of Ukraine, sentenced her to 3 years and 6 months imprisonment and released the defendant from punishment on probation if she does not commit a new crime and performs her duties within the 2 years of probation. There is no information regarding the appeal against the sentence by the prosecution.
