HOW TO WHO AND FOR WHAT WILL BE LUSTRATED IN TRANSCARPATHIA (DOCUMENT)

The Public lustration committee of Transcarpathian region prepared a document of appeal, which they gave to the newly appointed powers of the region 

In particular, to the head of the RSA V. Lunchenko, the chief prosecutor O.Sydorchuk, the head of the Regional Administrative Court O. Sheshenya. 

Here is the text. 

"APPEAL

We, representatives of public organizations and movements in Transcarpathian region who opposed the dictatorship of Yanukovych and coordinated our efforts and actions in November 2013. – February 2014,
• realizing the urgent need to protect the Ukrainian society and, in particular, communities of Transcarpathia, from the return of dictatorship or autocracy in new forms,
• understanding an exclusive importance of real changes in our country’s progress towards real reform in the interests of the nation and every person,
• initiating a qualitatively new and more effective reform and methods of the national struggle against total corruption, which erodes the Ukrainian government and society
• advocating the need for radical renewal of executive authorities and local governments at all levels on the basis of ethics, professionalism, integrity, transparency and accountability to communities, have established the Public lustration Committee (PLC).

The PLC provides the established criteria for consideration to persons authorized by the legislation of Ukraine to implement personnel policies within their authority. The PLC demands in a 3-day period to publicly inform the community on their willingness to collaborate with the PLC and to take into account the provided criteria and findings.

The criteria by which a person has no right to occupy senior positions in government:

1. The PLC believes that if a person in the period from 2010 to 2014 held the position from the list below in state or local government, law enforcement bodies, prosecution offices and courts, in state enterprises, he or she has no moral right to continue to occupy this position and has to resign voluntarily or to be dismissed and can not be appointed and hold public offices from the list for 5 years, namely:
• Heads of local state administrations and their deputies (regional and district state administration);
• Heads of structural divisions of the Regional State Administration (directors of departments, heads of offices).
• Heads and deputy heads of territorial branches of central executive bodies with special status.
• Heads and deputy heads of the district administrative court, local economic court and court of appeal, local general courts;
• Heads of local branches of state enterprises.

2. We also believe that members of the Party of Regions, the Communist Party of Ukraine, NGO "Young regions" and NGO "Ukrainian choice" shall also be subjected to public lustration process, moral conviction and dismissal from the above positions.

Criteria for candidates for executive positions.

We demand that the appointments to the positions listed above take place through public debate and public lustration procedure based on the following requirements:
• PROFESSIONALISM. Candidates must have a degree, positive references 
• INTEGRITY. Future officials can not be reasonably suspected of involvement in corruption offenses, other criminal offenses and violations of human rights and freedoms. It includes not only suspicions put forward by public authorities, but also those which appeared as a result of journalist investigations by media and influential non-governmental organizations;
• TRANSPARENCY OF ASSETS. Future officials, who have previously held positions in state government, must disclose to the media their declarations of assets, income and expenses and declarations of their family members prior to consideration of their appointment and subsequently annually in accordance with legislation and high public demand for transparency. The reported income must correspond to actual expenses of the person."
