Full lustration of power: tax officers will be checking civil servants in a European way

The Ministry of Finance of Ukraine, by the order of November 3, 2014 № 1100, has established the procedure for the State Fiscal Service of Ukraine verification of the declared information on presence of the property acquired by officials during their terms in government posts.

The inspections will be conducted by employees of the SFS of Ukraine and State Tax Inspectorates at the place of residence of the person subject to the inspection.

In particular, the inspection will consist of the following aspects:

1. Comparison of the information about the property (real estate, vehicles, money in bank accounts and other financial institutions, securities, contributions to the charter capital of enterprises) specified in a declaration by the citizen in respect of whom the inspection is conducted, with the real property acquired by the person during his or her terms in the government post.

2. Analysis of the tax information available to the supervisory authority on the income received by the person, in order to determine its legality, complete indication in the declaration and the possibility to purchase the declared property during his or her term in the government position.

It should be noted that the verification of the information will apply only to the person subject to the inspection, that is, the information on the income and assets of family members listed in the declaration of the civil servants shall not be checked.

The procedure also sets out the duration of the audit – sixty days from the date of its commencement.  After the completion of the verification, the report on its results shall be drawn up and sent to the head of the body as provided by Part 4 of Article 5 of the Law "On lustration of power." In addition, the SFS body. which carried out the inspection, shall send a copy of the report to the Ministry of Justice of Ukraine.
