Adventures of a Ukrainian at the Transcarpathian customs office: to the Czech Republic with a shocker and a club

Yesterday, September 2, a car "OPEL ANTARA" moving from Ukraine to the Czech Republic arrived at the customs post "Maly Berezny" of the Transcarpathian customs office. A citizen of Ukraine driving the car chose the customs control through the "green corridor".

Thus the citizen stated that the goods being moved by her across the customs border of Ukraine were not subject to a written declaration, payments of customs duties, statutory prohibitions and / or restrictions on import to or export from the customs territory of Ukraine. But exemption from filing a written customs declaration does not constitute the exemption from observance of the mandatory procedure for transportation of goods across the customs border of Ukraine.

Following the inspection of the vehicle and personal belongings of the citizen of Ukraine, they found a black telescopic metal baton with a total length of 54 cm unfolded and 21 cm folded, without any markings and a black and gray stun device in the form of a flashlight with a length of 13 cm, without any markings.

It should be noted that by the order of the Verkhovna Rada of Ukraine dd. January 24, 1995 №19-95-BP, para.8, the List of the types of property that cannot be owned by citizens, NGOs, international organizations and legal entities of other states on the territory of Ukraine was extended. The list includes, in particular, stun devices and special tools used by law enforcement agencies.

Thus, the citizen of Ukraine violated the established order of customs control in the area of the simplified customs control by carrying items which are limited for transportation across the customs border of Ukraine. These actions have signs of violation of customs rules under Article 471 of the Customs Code of Ukraine. Based on Article 511 of the Customs Code of Ukraine, the items in question were seized.
