A woman’s request led to the seizure of a minibus “Mercedes-Benz” and a scooter “Shark” from a Ukrainian

Recently, at the ​​customs post "Tisa" of the Transcarpathian customs office, a scooter "Shark" and a minibus "Mercedes-Benz" were seized from a Ukrainian. The reason was a failure to mention in the customs declaration and the transportation of goods across the customs border of Ukraine using a specially manufactured cache.

A citizen was heading from Ukraine to Germany. Having completing a customs declaration and specified the details about the vehicle – a minibus "Mercedes-Benz" – he verbally confirmed the information given and denied the presence of any other goods, including those subject to a written declaration or prohibition or restriction for transportation across the customs border of Ukraine.

However, during the customs inspection of the Ukrainian’s vehicle by the customs authorities, they found a used scooter of the brand "Shark" in a disassembled state. The found scooter was in a specially made cache, the so-called "dual partition" between two fake walls edged with the same fabric as the interior of the minibus. The access to the scooter became possible only after the complete dismantling of the cache assembly.

In his explaination, the citizen said that he was carrying the found vehicle at the request of a woman who later had the intention to have a customs clearance performed. In addition, according to the provided registration certificate for the scooter "Shark", the scooter is not removed from the register and is registered in Germany for a German citizen.

Note that, in accordance with the Customs Code of Ukraine, goods (excluding excisable goods) the total invoice value of which exceeds the equivalent of 500 euros, and the total weight of which exceeds 50 kg, being imported through entry points into the customs territory of Ukraine, shall be subject to a written declaration and subject to payment of customs duties.

Thus, the citizen committed acts aimed at moving goods across the customs border of Ukraine concealed from customs control, ie using specially manufactured caches. These actions have signs of violation of customs regulations under Part 1 of Article 483 of the Customs Code of Ukraine. Under Article 511 of the Customs Code of Ukraine, the direct objects of violation of customs rules – minibus "Mercedes-Benz" worth over almost 300,000 UAH and scooter "Shark", the cost of which is being established – were seized.
