A woman involved in the incident at the store “Korzo” was threatened with murder. The prosecutor’s office initiated criminal proceedings

The First Deputy Prosecutor of Uzhgorod Local Prosecutor’s Office Ivan Savko: "The prosecutor’s office launched criminal proceedings into the death threats to a woman involved in the incident at the store on Korzo street.

According to the first deputy prosecutor of Uzhgorod Ivan Savko, the applicant appealed to the law enforcement officers and reported that some people would not let her open the store which she co-owns and threatened her with physical violence. A group of Uzhgorod police department and the duty officer of Uzhgorod local prosecutor’s office arrived at the scene.

Uzhgorod local prosecutor’s office launched criminal proceedings over this fact under Part 1 of Art.129 of the Criminal Code of Ukraine – the threat of murder – punishable by arrest for up to six months or restriction of liberty for up to two years. Ivan Savko added that besides that, the woman reported that between 15 to 16 of August, 2015, the people that she knows dug a hole in the shop and stole the tenants’s property.

Also, the prosecutor noted that during the check it was revealed that civil disputes over the aforementioned facility are ongoing. However, according to the Register of immovable property rights, neither the applicant nor members of the "Mahazyn Vzyttya" LLC own this property.

The woman demanded the law enforcement officers to intervene and influence the individuals who would not let her in the shop. But at that time, the police officers had no reasons for inspection of the scene, namely the shop. Because, according to Part 1, Art. 233 of the CCP of Ukraine, nobody has the right to enter the dwelling or other property for any purpose other than with voluntary consent of the person who owns them or under the decision of investigating judge. According to Part 4 of Art. 334 of the CC of Ukraine, the right to property, which is subject to state registration, arise at the date of such registration under the law.

Therefore, Ivan Savko said that prosecutors would continue to take all measures to establish the rule of law and protect the rights of citizens, but only in the manner provided by law.
