According to the new Criminal Procedure Code, the regional prosecutor announced to the head of the village of Zabrid the suspicion of a criminal offense under Part 2 of Art. 364 and Part 2 of Artt.366 of the Criminal Code of Ukraine (abuse of power or position and forgery – punishable with imprisonment for a term of three to six years, with deprivation of the right to occupy certain positions or engage in certain activities).
According to the senior prosecutor of the department for supervision during the pretrial investigation Bohdan Uhrynyuk, in December 2006, the head of the village of Zabrid in Khust district by forging the decision of the village council session granted to three citizens the land in total area of 0.63 hectares for housing purposes. However, these lands belong to industrial land and according to the law are prohibited to be granted to private ownership without previous change of their purpose.
Therefore, with his illegal actions Zabrid village head harmed the interests of the state in the amount of about 300,000 UAH, which is the legal and monetary value of these lands.
