What families of soldiers need to know

The press center of the Transcarpathian Regional Military Commissariat distributed clarifications on certain issues of social protection and rehabilitation of participants in the antiterrorist operation.

According to Article 6 of the Law of Ukraine "On the Status of War Veterans and Guarantees of their Social Protection" (hereinafter – the Law), soldiers (reservists, persons subject to military service), who have defended the independence, sovereignty and territorial integrity of Ukraine and taken part in the anti-terrorist operation, shall be recognized as combatants.

 

 

Confirmation of participation in the anti-terrorist operation and its duration is the responsibility of the anti-terrorist operation command by issuing relevant orders, which are certified by the signature and the seal of regional or central authority of the Security Service of Ukraine.

 

Regarding the coordination of the activities of the Ministry of Defence of Ukraine for the purpose of documentation of injury, concussion, death and persons responsible for the issuance of documents, confirming that this event occurred while participating in combat operations in the ATO area, the following should be noted.

The Armed Forces of Ukraine define the procedure for registration and issuance of certificates of injury (death) of soldiers of the Armed Forces of Ukraine.

The examination of dead bodies is carried out by forensic experts of the Ministry of Health of Ukraine, who establish the cause of death and draw out a report on postmortem examination of the corpse, based on which a death certificate is issued.

In turn, the commander of the military unit orders to conduct the investigation into the death of a soldier.

The military commissariat at the place of residence of the deceased soldier receives an excerpt from the order of the commander of the military unit to exclude him from the list of military unit personnel specifying the circumstances of death, of which the military commissioner shall notify the family of the deceased.

Based on the medical certificate of death, departments of death registration of the Ministry of Justice of Ukraine issue a certificate of death of the deceased.

Military medical commissions of the Ministry of Defense of Ukraine establish the cause of diseases (injuries, contusions) and death of a soldier according to the Provisions of military medical examination in the Armed Forces of Ukraine.

To establish the cause of injury and death of a soldier and to obtain financial assistance. relatives of the dead soldier must provide to the military medical commission the following documents: death certificate, medical certificate of death, an extract from the order of the commander of the military unit to exclude the soldier from the list of the military unit personnel specifying the circumstances of the death of the soldier, other military records (excerpt from the track record, the act of investigation of the death of the soldier, etc.) if available.

Following the review of the documents, the Commission shall decide that the cause of death and injury of the soldier is related to performance of military duties.

Excerpts from the minutes of the commission meeting shall be provided to the Department of Finance of the Ministry of Defense of Ukraine to receive cash benefits.

In case of disability, a soldier receives the status of disabled veteran and the appropriate certificate issued by social security agencies of the Ministry of Labour and Social Policy of Ukraine.

In order to search for military prisoners, or search for soldiers who have gone missing, in the Ministry of Defence of Ukraine, there is the working group for the liberation of the soldiers of the Armed Forces of Ukraine, who are illegally held prisoners by illegal armed groups.

This group has established cooperation with representatives of the Presidential Administration of Ukraine, the Security Service of Ukraine, the Ministry of Internal Affairs of Ukraine, the National Guard of Ukraine and the State Border Service of Ukraine to exchange information regarding illegally detained persons, to take measures for their release. On this issue, in the Department of Military Police of the Armed Forces of Ukraine, there a "hot line" (tel. 454-73-15) regarding the liberation of the soldiers of the Armed Forces of Ukraine, who are being illegally kept in captivity.
