Today the new Criminal Procedure Code comes into force

Today the new Criminal Procedure Code comes into force.

The new CPC, among other things, cancels additional investigation of the criminal case.

The Criminal Procedure Code expands the list of grounds for detention or taking a person into custody, limits the term of detention in remand prison: for mild and moderate offenses – up to 6 months, for grave and especially grave offenses – up to one year.

Under the provisions of the new CPC, lawyers receive much more power. In particular, a power to apply for the removal of any witnesses or documents.

The norm, which allowed to involve close relatives of defendants for their defense, is not in the new code.

New CPC establishes the State Bureau of Investigation.

On May 14, the President of Ukraine Viktor Yanukovych signed the Criminal Procedure Code and the Law № 4652-VI "On amendments to some legislative acts of Ukraine in connection with the adoption of the Criminal Procedure Code of Ukraine."

The Parliament passed the Criminal Procedure Code of Ukraine on the night of April 13.

The Parliament was considering the draft CPC for four days, starting from April 10.

 

In total, more than 3700 amendments to the code were made.

The opposition claimed that the CPC was adopted with violations.

The people urged the President not to sign the CPC as it was adopted in violation of the procedure.
