Recall that in the summer of 2017, several months before the expiration of the contract, despite the moratorium, the tenant began the construction in the green zone.
Subsequently, on December 21, 2017, the Uzhgorod City Council adopted a decision to deny the tenant in prolongation of the lease agreement for a 0.4 hectare land plot for commercial housing construction.
Disagreeing with this, the former tenant of the land plot – "Pidlypnyky" Ltd. – filed a lawsuit in which they asked for the above-mentioned decision of the city council to be canceled, as well as to recognize the contract prolonged for the same period and on the same terms.
On March 20, 2019, a hearing of the Economic Court took place, the trial was attended by the Uzhgorod Local Prosecutor’s Office, the apartment building co-owner association "Mozhayskogo, 34" and the city community, who, together with the Uzhgorod City Council, opposed the claims.
According to the legal department of Uzhgorod City Council, the court, having reviewed the evidence provided by the parties and having heard the explanations of the attorneys, decided to deny the extension of the lease agreement and thus supported the position of Uzhgorod City Council to ban the construction in the green zone at the corner of Mozhaysky – 8 Bereznya streets.
