The Court of Appeal denied the re-examination of Nahirny

The father and husband of the victims is stunned by the decision of the court.  Today, February 15, at the Appeal Court of Transcarpathian region, the judges, having considered the claim of the victims, decided to refuse to request a psychiatric re-examination of Nahirny. Motivation of the decision will be read out on February 19 in the Court of Appeal.  

Near the court building, about a dozen relatives and friends of those, who were killed and injured in the terrible accident, were standing with posters "Guilty must be punished."

They demanded that the court did not let Pavlo Nahirny avoid criminal liability and hide behind mental insanity.

The victims’ lawyer Mykola Havrylets said that on February 23 the pre-trial investigation on the accident must be referred to the court. The victims assume that Nahirny will try to avoid prison because Lviv doctors recognized him insane. However, all previous examinations did not indicate any mental disorders of the perpetrator in an accident.

Recall that the case is tried under the claim of the injured party in the accident involving the head of Khust branch of "Zakarpathaz" Pavlo Nahirny.

November 19, 2012, near the city of Khust, the traffic accident occurred, resulting in the deaths of 32-year-old woman and her 7-year-old daughter and two more children getting injured. It was established that at the 68th km of the road Mukachevo – Rohatyn – Lviv, the driver of "Mitsubishi Pajero" Pavlo Nahirny drove into the oncoming lane and collided with the oncoming car "Daewoo Nexia" driven by the 32-year-old Halyna.  As a result of the collision, the woman and her baby daughter died and car passengers – two children – were hospitalized with severe injuries.
