Under the claims of Uzhgorod prosecution office, four decisions of the City Council on allocation of land in the "Zakhidny" neighborhood in area of over 40 hectares, valued at over 12 million hrynias have been canceled.These areas are the floodplain and are not intended for the construction and maintenance of residential buildings.
Those violations of the law were found out by the prosecutor’s office while checking compliance with the land laws when making relevant decisions by Uzhgorod City Council.
Specifically, in 2009, officials of the institution provided a number of permits for preparation of materials for selection of land plots for the construction and maintenance of residential buildings.
However, those decisions were taken in contravention of the Water and the Land Code of Ukraine.
According to the mapping of flood and risk zones in the basin of the Uzh, developed within the project "Improvement of flood management system," the land of residential quarters "Zakhidny" is located between the watercourse and the dam of the Uzh river, that is it is a floodplain area that may be flooded. According to the Water Code of Ukraine, construction of residential buildings in such areas is prohibited.
In connection with the violation of the current legislation, the prosecution appealed to the Uzhgorod city and district court with a claim for cancellation of the said decisions of the City Council. Canceling the illegal decisions, the court upheld the prosecution’s claims.
