Prosecutors demand to return the community of Mukachevo the land in area of ​​over 5 hectares and worth about UAH 12 million

Prosecutors of Mukachevo protects the interests of the local community of Mukachevo on rational use of land for commercial purpose that has not been used.

Transcarpathian Region Economic Court opened the proceedings on the case initiated by the prosecutor of the city of Mukachevo in the interests of Mukachevo City Council to terminate the right of permanent land use, invalidate the certificate for the right to permanent use of land and to return to the reserve lands of the city the land plot with a total area of ​​more than 5 hectares worth about UAH 12 million.

After the prosecutor’s analysis of the legality of land use under state certificates for the right to permanent use, it was found out that based on the decision of the executive committee of Mukachevo City Council, in 1999, an entity received a state certificate for the right of permanent land use.   

Under the decision of the Commercial Court, the entity dissolved in 2011, therefore, according to the Land Code of Ukraine, the right to permanent land use shall be terminated, and the state certificate shall be recognized invalid.

Due to the above circumstances, in order to protect the interests of the state represented by Mukachevo City Council, the Prosecutor’s Office filed the said claim to the Economic Court of Transcarpathian region.
