Prosecutors appealed on “The Crown” case

Yesterday, January 23, Uzhgorod prosecutors appealed the decision of the Commercial Court of Transcarpathia dd. 10.01.2013, declaring the exclusion of "The Crown" complex as legal. 

The grounds for the appeal of the court decision is a violation of substantive and procedural law regarding the evaluation and examination of evidence during the trial, including compliance with applicable law of the object, the method and the procedure of the privatization of built premises at Teatralna sq., 5, 7.  

The position of the prosecution in this case is solid: the sale of "The Crown" must be recognized invalid, as it was done in violation of the Law of Ukraine "On privatization of small state-owned enterprises (small privatization)," the Law of Ukraine "On the assessment of property, property rights and professional activities in Ukraine" and the Procedure for the sale of small-scale objects.

In addition, prosecutors of Uzhgorod have opened two criminal proceedings that directly relate to illegal actions concerning "The Crown".  The first: over the fact of violation of the procedure for privatization of the specified property.

    

The second: provided under Part 1 of Art. 382 of the Criminal Code of Ukraine (default in fulfillment of judgment – punishable by imprisonment for a term up to three years) against officials of the Department of Municipal Economy of Uzhgorod City Council.

Uzhgorod prosecutors found out that despite the court ban to take any action to conclude contract of sale and register the ownership for "The Crown" complex, officials of the Department of Municipal Economy of Uzhgorod City Council had made the decision on registration of ownership for the basement of the complex with total area of ​​over 85 square meters
