Once again on mini-hydropower plants in the Carpathians: the prosecutor’s office is charging the village council in Rakhiv district for “public hearings”

Transcarpathian Prosecutor’s Office started the investigation regarding the case of the permission for the construction of mini-hydropower plant in Rakhiv district "organized" by a village council officials.

On behalf of the district prosecution office, the investigation department of Rakhiv District Police registered in the URPI and started pre-trial investigation in the criminal proceeding initiated on the fact of service negligence by officials of a village councils in the district (Part 1 of Art. 367 of the Criminal Code of Ukraine).

According to the deputy prosecutor of Rakhiv district Lesya Kabal, currently it has been established that in June 2013 officials of the village council, improperly performing their duties, illegaly organized and conducted illegitimate and invalid public hearing on public interest in consideration and making decision on granting a private company the permission for construction of a derivational type small hydroelectric power plant in Rakhiv district.

As a result, without having published the results of public hearings, as prescribed by the law, the village council decided to approve for the private enterprise the detailed plan for construction of a small hydroelectric power plant in the village and beyond.
