New Criminal Procedure Code complicated the procedure of issuing body of the deceased for funeral

With the introduction of the new CPC relatives of the deceased have to wait more than a week to receive the body for burial.

Now the relatives of the deceased must obtain permission from the prosecutor’s office. As a result, morgues already started to complain about the lack of places, and relatives have to wait more than a week to receive the body.
The Article 238 of the new Criminal Procedure Code "Examination of a corpse" provides a mandatory examination of a body by investigator or by prosecutor and forensic expert. In fact, it equated those who died natural death and those who died violent death.
"Before, these permits (for burial – ed.) were issued by the police, who had all documents, and could respond. And now all permits shal be issued by the prosecution," – said Holosiyiv District Prosecutor of Kyiv Dmytro Lyushenko.
Employees of morgues told the reporters that they may not have enough place or professionals. Almost every newcomer is subject to autopsy, which in the state morgue now costs on average one thousand gryvnias.
"It is a shame to say that, but the business begins with a statement of a person’s death. And everyone wants to take profit from this business" – the director of funeral company Vadim Malinowski commented on the situation.
