Moskal went all-in!

Moskal: "The result of the referendum on special self-governing unit of Transcarpathia will be invalidated by a court"

         Hennadiy Moskal filed a lawsuit with the District Administrative Court to recognize the results of the referendum December 1, 1991, which concerned the provision of the status of a special self-governing unit within Ukraine for Transcarpathian region, as not legally binding. And to abolish the relevant decisions of Transcarpathian Regional Council. The lawsuit is related to the publicity that arose about the Transcarpathian Regional Council’s appeal of April 5 this year to the top management of Ukraine to give more authority to the region within the constitutional reform on decentralization.

– The referendum of 1991 was illegal in part of provision of a special status to the region – H. Moskal said. – It directly contradicted the then Law of Ukraine "On national and local referendums", Art. 4 of which states: "The subject of a local referendum may be adoption, amendment or repeal of decisions on matters that, according to the laws of Ukraine, are within the competence of relevant administrative unit local government, as well as adoption of decisions that determine the content of the resolutions of local councils and their executive and administrative bodies." The issue of amending the Constitution can be considered by the constitutional majority of the Parliament, so the results of the Transcarpathian referendum had no and have no legal effect whatsoever, all that they can do is to give rise to various political speculations, as it happened this time.

If in 25 years, no one has thought of invalidating the results of the referendum inspired the then KGB and the Communists and the related decisions of the Regional Council, which were aimed to undermine the situation in Ukraine, then I will do it. When the judgment is made, the result of the referendum will be thrown into the dump of the history of Transcarpathia. 

Recall that on April 5, members of the Transcarpathian Regional Council approved an appeal to the President, the Prime Minister and the Speaker of the Parliament, the main theme of which was the amendment of the Constitution of Ukraine and provision of extensive administrative and financial powers to local authorities (the text of the appeal is available HERE).
