Moskal offers to include Uzhgorod judge Sochka to textbooks on jurisprudence

People’s Deputy Hennadiy Moskal has written the deputy appeal to the head of the Supreme Council of Justice Volodymyr Kolesnichenko to dismiss the judge of Uzhgorod district court, Vitaly Sochka, for violating the oath of office.

The deputy appeal concerns the decision that V. Sochka adopted on December 24, 2012, under the lawsuite of a commercial bank to an Uzhgorod entrepreneur to collect outstanding loans. Despite the fact that several handwriting experts concluded that signatures on the loan agreement, vehicle mortgage agreement and repayment schedule of the loan did not belong to the defendant (ie, were falsified), the judge decided that the loan agreement was concluded orally and found it valid. Then, he decided to recover 882,000,579.65 UAH against the entrepreneur in favor of the bank.

As stated in the deputy appeal, by his inadequate decision V. Sochka violated the oath of a judge, that is he committed acts that disgrace the judiciary, raise doubts as to the objectivity, fairness and integrity of the judiciary.

– The Uzhgorod judge adopted the decision that contradicts common sense and deserves to be included in textbooks on law as an example of incompetence and bias – H. Moskal commented on his appeal. – According to his logic, any person can be obliged to return loans on the grounds that the loan agreements were concluded orally.

Now, the case on the oral loan agreement is pending in the Court of Appeal of Transcarpathian region.
