Commenting on the decision of the Commercial Court of Transcarpathia, which obliged Uzhgorod Airport to pay the Corporation a compensation for unlicensed software, Microsoft Ukraine has indicated that more than 70% of the software in government institutions is unlicensed.
This was the first case against the utility company, when the court ruled in favor of Microsoft. Thus, during the process, which lasted over a year, the court found out that Uzhgorod airport had used six terminals with pirated software.
Despite the fact that the criminal investigation was terminated due to the inability to find out who exactly had installed the unlicensed software in the institution, the copyrighter appealed to the Commercial Court for compensation. The court ruled that the company as the owner of computers is responsible for the software installed on them.
In addition, the court noted that each pirated software is a single fact of violation of intellectual property rights, for each of which the company should pay compensation not less than 10 minimum wages (about 10 thousand hryvnias).
Microsoft Ukraine also reported that their legal representative sent warning letters to 25 major Ukrainian companies suspected of using illegal Microsoft software. Just last month, the corporation filed 10 civil lawsuits for compensation (the amount of the claim exceeds 1.586 million hryvnias). Overall, in the Ukrainian courts there are 60 criminal cases of Microsoft copyright infringement.
