Perechyn District Prosecutor’s Office conducted checks of compliance with the Budget Code of Ukraine and the Law of Ukraine "On regulation of urban development" in four village councils in the district.
According to the Perechyn District Prosecutor Oleksandr Bratyuk, it was found out that the provisions on the involvement of developers (customers) to equity in the development of engineering, transport and social infrastructure in the respective localities adopted by the said local authorities did not fully meet the requirements of Article 40 of the Law of Ukraine " On regulation of urban development."
In addition, the check found out that during 2010-2013, in the said village councils they were building facilities and putting them to use. However, local authorities, in violation of the Budget Code of Ukraine, the Law of Ukraine "On regulation of urban development", did not take measures to involve those developers to share participation in the development of infrastructure in respective settlements, appropriate contracts (except for Dubrynychi village council) were not concluded, the funds in the form of shares were not paid by developers, leading to a significant shortfall in local budgets.
Reacting to detected violations, the District Prosecutor made a submission with the request to bring local regulations on the involvement of developers (customers) to equity in development of engineering, transport and social infrastructure in settlements in line with the Law of Ukraine "On regulation of urban development", to take measures to conclude agreements with developers, to pay the due amounts, and to bring the the responsible officials to justice.
Currently, the submission is pending in court – the press service of the prosecutor’s office in the region reported.
