How Transcarpathians can find common ground with Hungarian employer

Due to the shortage of labor personnel, Hungarian companies often attract foreign workers, the Myhungary.net informs. Those are not only EU citizens, who can move freely within the European Union, but also workers from Vojvodina, Transylvania, Transcarpathia. Representatives of these regions have good skills of Hungarian spoken language. But things are much more difficult when it comes to understanding the intricacies of business spoken language, grammar rules and legal terminology when drafting documents for employment.

Hungary’s Labour Law does not provide for any regulations related to the language spoken in the employment relationship. However, there are general requirements for relations between an employer and an employee under the same rules. For example, the parties in the performance of duties and the exercise of their rights shall act according to the principle of good faith and fairness in terms of teamwork, without prejudice to the legitimate interests and mutual trust (Mt. 6. § (2) 4. (Megállapította: 2013. évi CCLII. However, the Labour Law provides for an additional requirement. In particular, in order for written legal statements made in the course of labor relations to be recognized as valid, they must be understood by an employee. According to Mt. 22. § (7), in cases where an employee can not read or does not understand any document, an employer is obliged to make its content understandable for an employee, and the documents should be read and explained involving an autentification person.

To avoid disagreements and disputes, key documents on labor employment shall be executed as a bilingual file. If foreign language skills is the main criterion of employment, an employer shall have no ground to refuse to communicate in this language, but in this case the principle of good faith and fair exercise of the rights of the parties stipulated in the Law on Labour (2012. évi I .
