Former chief doctor of Uzhgorod Perinatal Center did not recognize his own signature

Uzhgorod District Court continues the hearing on the claim of the former head of Uzhgorod City Perinatal Center (UCPC) Ruslan Fedko against Uzhgorod City Council regarding his reinstatement.

The former chief doctor decided to return to the managerial position, which he had resigned from two years ago on his own accord. Thus, he demanded to recognize the mayor’s order invalid and reinstate him on the previously occupied position. In addition, Fedko claims that he never wrote a statement of resignation.

 However, the plaintiff was presented with the record of his resignation in May 2011. The record was made in the journal of labor books.   

At a previous court hearing R.Fedko could not remember where his papers were, and today, January 25, during the hearing he could not recognize a copy of his own statement of resignation. It was presented by the city prosecutor’s office representative, who joined the process. The defendant – a representative of the city council – could not answer where the original document, written by R. Fedko, was. So obviously, he is not making effort to prove the legitimacy of the mayor’s order on Fedko’s dismissal, therefore the burden of bringing proof lays on the prosecution, which has joined the process under Article 36-1 of the Law of Ukraine "On Prosecutor’s Office".

Having acquainted with the case, the judge went in the consultation room. She promised to announce her decision in the morning on Monday, January 28. uzhgorod.in will follow the case.
