Border guards are not obliged to “report “

The State Border Guard Service of Ukraine receives many appeals from citizens and certain officials, as well as from various organizations to provide them with information on border crossing by third parties.

However, the State Border Guard Service of Ukraine acts exclusively within current legislation. In particular, according to Art.32 of the Constitution of Ukraine, no one shall be subjected to interference with his or her private and family life, except in cases provided by the Constitution of Ukraine. Also no collection, storage, use and dissemination of confidential information about a person without his or her consent is allowed, except in cases specified by law, and only in the interests of national security, economic welfare and human rights.

The Border Guard Service informs that the information about crossing the border by a person is a part of his or her private life, and the protection against improper dissemination of such information is provided by the Law of Ukraine "On Personal Data Protection". That is why it can be disclosed only with the consent of such person. In addition, under current legislation, such information may be provided by border guard authorities only at the written request of the court, prosecution office, inquiry and investigation authorities. 

Once again, we note that the State Border Guard Service of Ukraine acts exclusively within legislation and its authority under current law, and therefore accusations of improper actions or, as sometimes happens, covering certain officers and officials are absolutely unfounded, the press service of the State Border Guard Service informs.
