Zakarpatgaz considers AMCU’s decision to be a squeeze on business and will sue

The regional gas company considers the decision of the AMCU on penalties for bringing gas to standard conditions to be a government’s squeeze on business.

December 10, 2019, Kyiv. The Antimonopoly Committee of Ukraine, without understanding the situation, made a hasty and unjustified decision to fine the gas operators for bringing gas to standard conditions when measuring the volumes of gas consumed.

By forbidding to bring gas to standard conditions, public authorities and the AMCU violate the principle of measurement consistency and discriminate against consumers, forcing some to pay for others.

Bringing the gas to standard conditions is envisaged by the Law of Ukraine “On the Natural Gas Market”, the Gas Distribution Systems Code, the Model Natural Gas Distribution Agreement, and the Natural Gas Supply Rules.

The RGC regards such actions of the AMC as a glaring display of government’s squeeze on business. The AMCU decision is detrimental to the entire gas industry and makes it impossible to introduce European rules for the functioning of the gas market, so it will be challenged in court.
