Transcarpathian region prosecutor’s office appeals the court decision on the high-profile “Kirpichka” case

The Prosecutor’s Office submitted a cassation appeal to the Supreme Economic Court of Ukraine on "Kirpichka" in connection with the fact that the courts of first and appellate instances denied the prosecutors’ claim.

As previously reported, the prosecutor of Uzhgorod on October 5, 2015 appealed to the Economic Court of Transcarpathian region with a claim to Uzhgorod City Council, the Department of Municipal Economy of the City Council, the "Uzhgorod-Market" LLC for recognition as illegal and abolition of the decisions of the City Council dd. 26.01.2007 and 23.11.2007 regarding the approval of the location, construction of recreational facilities and granting the "Uzhgorod-Market" LLC the lease of land in area of 6 hectares worth over UAH 74 million, invalidation of the lease of this land and its return to Uzhgorod City Council. The claims are supported by the fact that this land, being the land of recreational purpose, was leased for commercial use, namely for the construction of a multifunctional shopping and entertainment complex, which includes a hypermarket, a supermarket of building materials, a gallery of boutiques, a cinema, a computer club and more. In addition, on this land, there is a pond in area of ​​2.66 hectares, the right of use whereof is not registered in the prescribed order. It should be noted that the claims of the prosecutors were acknowledged by Uzhgorod City Council and the Department of Municipal Economy of Uzhgorod City Council.
