The preliminary investigation revealed that in the evening of November 19, 2012, Pavlo Nahirny, while being intoxicated, driving a car "Mitsubishi Pajero", on the 68th km of the bypass road in the city of Khust, grossly violated the Road Traffic Rules of Ukraine – drove into oncoming traffic and collided with a car "Daewoo Nexia GIX" driven by a 32-year-old woman with three children as passengers.
As a result of the tragic accident, the woman and her 7-year-old daughter died, and the other children were seriously injured. Pavlo Nahirny himself, without suffering any major injuries, left the scene of the tragedy. Later he tried various methods to avoid justice, and even was hiding in Hungary where he was found and extradited to Ukraine.
Therefore, the prosecution reasonably accuses Nahirny of a criminal offense under Part 3 of Art. 286 of the Criminal Code of Ukraine – violating Road Traffic Rules of Ukraine by a person driving the vehicle that caused the death of several persons and severe injuries to victims.So now the court will decide the fate of the accused.
The sanction of this Article provides for punishment in the form of imprisonment for a term of five to ten years with deprivation of the right to drive vehicles for up to three years.
