Prosecutors of Uzhgorod defended in court the rights of a disabled, who was illegally fired, and in addition to reinstatement at work, he will be refunded over 5,500 UAH for the period of his forced absence.
According to Acting Prosecutor of Uzhgorod Ivan Demyanchuck, "A 64-year-old resident of Uzhgorod appealed to the prosecution office in Uzhgorod to protect his rights in court. During the prosecutor’s inspection, it was found out that the applicant had worked on one of Uzhgorod companies since 1994. About three months ago, the new head of the company turned to him with a demand to immediately retire voluntarily in connection with the reorganization of the Company. The man refused to obey this demand.
From August to September 2013, he was sick and was being treated in hospital, about which he informed the administration of the Company and the Director by phone. Nevertheless, upon coming to back work on September 2, the employee learned that he had been dismissed back on August 9, ie during the period of temporary disability.
The illegally dismissed employee appealed to the Uzhgorod district court about the director’s actions.
Having studied the materials of the claim, Uzhgorod prosecutors agreed on the need to take part in the trial because the plaintiff was an elderly person, disabled of the second group, and therefore could not protect his own interests in court.
Therefore, by the decision of Uzhgorod city and district court, the illegal order of the director of the company was reversed, and the illegally dismissed worker will be paid more than 5,500 UAH for the forced absence.
