Criminal responsibility for illegal collection of gravel from rivers

Transcarpathians face criminal responsibility for the illegal mining of sand and gravel from the bed of the Latorica river

During the inspection of ​​the Latorica river near the village of Nove Davydkovo in Mukachevo district, the policemen detected an illegal collection of sand and gravel using trucks "Kamaz". Thus, local residents illegally, ie without construction documents approved by the relevant authorities, had taken from the Latorica river about 6 m³ of sand and gravel.

According to the Mukachevo district prosecutor Oleg Opishnyak, October 24, they checked the legality of mining of sand and gravel from Latorica river in Nove Davydkovo village council in Mukachevo district.   

Sand and gravel materials are minerals of national importance, and in accordance with Article 86 of the Water Code of Ukraine, any works associated with mining operations shall be carried out under the project agreed with the Environment, Water and Geology authorities.

This fact was registered in the Unified register of pre-trial investigations with preliminary legal classification of the criminal offense under Part 2 of Art. 240 of the Criminal Code of Ukraine – illegal mining of minerals of national importance. The pre-trial investigation was initiated.

Part 2 of Art. 240 of the Criminal Code of Ukraine – violation of rules of protection or use of mineral resources, as well as illegal mining of minerals of national importance – punishable by a fine of four hundred to seven hundred tax-free minimum incomes, or restraint of liberty for a term up to three years, or imprisonment for the same term.
