As previously reported, the officers of the municipal police of Uzhgorod city council allow themselves to behave insolently with entrepreneurs, threatening them with fines.
We obtained another documents confirming this – if employees of the city council, including the municipal police, threaten you with a protocol of violation, or have already drawn up it – this is not yet the final results.
A typical conflict between a female entrepreneur and employees of the City Council is described in the Resolution of the City and District Court dd. 15.07.2013.
As stated in the document, the plaintiff learned in the bailiffs’ service that there was a decision of the administrative commission against her, under which she had to pay a fine of 850 hryvnias, because there was no garbage can near her shop. Thus she allegedly violated landscaping rules, which the municipal police is in charge of.
The woman went to court and it found out that the protocol on violation had been drawn up in the absence of the entrepreneur, and the copy of the protocol had not been handed to the plaintiff.
No representative of the city council even appeared in the court to prove the legitimacy of the Municipal Police actions.
Thus the court decided to upheld the claim of the entrepreneur in full, and to cancel the decision on violation of landscaping.
This life story again clearly shows that we should not be afraid of Uzhgorod city government and defend our rights in court.
By the way, Uzhgorod city government lose most of the cases in courts. Probably because their representatives often allow themselves a priori illegal actions.
