The prosecutor’s office launched criminal proceedings

Khust Interdistrict Prosecutor’s Office initiated criminal proceedings over the fact of committing criminal offenses under Art. 364, Part 3 of the Criminal Code of Ukraine (abuse of power or position by an employee of a law enforcement agency).

According to Kuhst Interdistrict Prosecutor Ivan Kailo, prosecutors conducted an audit as part of the supervision over the observance and application of forest legislation in Velyatyno forestry of the SE "Khust LDH", which revealed that in April this year after the spring inspection of forest management, officials of the Velyatyno forestry of the SE "Khust LDH" performed illegal, unauthorized felling in two blocks of the specified forestry.

Ivan Kailo noted that "these illegal logging destroyed 22 cubic meters of such tree species as oak, hornbeam and beech."

Thus, the illegal actions of officials of the Velyatyno forestry of the SE "Khust LDH" caused damage in excess of 60,000 UAH.

Part 3 of Art. 364 of the Criminal Code of Ukraine – the abuse of power or position, that is intentional, for mercenary motives or other personal benefit or the benefit of any third party use of official authority or official position contrary to the interests of the service, if it caused substantial harm to legally protected rights, freedoms and interests of individual citizens or state and public interests, or interests of legal entities, if committed by a law enforcement authority, – shall be punishable by

imprisonment for a term of five to ten years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to three years and confiscation of property.
