Prosecutors of Uzhgorod revealed the illegal decision of the City Council, whereunder a resident of Uzhgorod and the Department of Municipal Economy concluded the contract of servitude use of the land on Pravoslavna embankment.
According to the senior prosecutor of Uzhgorod Vadim Savchak, the agreement has not been officially registered, thus, has not entered into force and shall be deemed illegal (violation of Art. 98, 116, 123 of the Land Code of Ukraine). Thus, Uzhgorod City Council exceeded its authority because, according to the land law, the permit to enter into a short-term contract does not authorize to grant the use of land belonging to the local community.
Currently, the resident of Uzhgorod, who illegally started the construction on Pravoslavna embankment, is brought to administrative liability (Art. 53-1 of the Code of Ukraine on Administrative Offences – unauthorized occupation of land). The City Prosecutor’s Office prepared a petition to the court for the return of land to local community ownership and demolition of the kiosk built on it.
