Deputies propose to eliminate the court that deprived Baloha of the mandate

Deputies from the "Batkivshchyna" party Yuri Odarchenko, Andriy Pavlovsky, Stepan Kurpil and Oleksandr Chornovolenko suggested the parliament to eliminate the Supreme Administrative Court. This is stated in the bill, registered in the Parliament on February 20, reported the "Ukrainska Pravda".

The bill proposes to amend the law "On the Judicial System" and to exclude the Supreme Administrative Court from the system of courts of general jurisdiction.   It is also proposed to authorize the Chamber of Administrative Cases of the Supreme Court with the powers of the Supreme Administrative Court.

In addition, they propose to instruct the state judicial administration to ensure the liquidation procedure of the Supreme Administrative Court and to determine the body that will temporarily keep its archives and ensure the issuance of copies of its documents. The bill proposes to recommend the Supreme Court within 6 months after the enactment of the law to make proposals to the parliament on the appointment of the court of cassation for administrative cases.

In the memorandum it is stated that the Supreme Administrative Court discredited itself, particularly in cases related to elections in 2012. As you know, February 8, the Supreme Administrative Court deprived deputies Pavlo Baloha and Oleksandr Dombrovsky (both – independent) of their deputy mandates. The Central Election Commission does not intend to fulfill the decision of the Supreme Administrative Court if it contradicts the Constitution. 61 members of the Parliament requested the Constitutional Court to review the constitutionality of the decision.
