According to the head of the State Architectural Control Department of Uzhgorod City Council Oleksandra Zotova, under the construction passport issued this year by the department of city planning and architecture of the Transcarpathian Regional State Administration, a one-storey residential building is supposed to be built at Koshitska st., 21. It is worth noting that, according to the permits, it should be not even a new construction, but a reconstruction.
But, according to Mrs. Zotova, what has already been built there now – a basement with partitions inside, frames for transom beams for the installation of floors – shows that it is not going to be a one-storey building. Also, under the construction passport, the area of this building must be 280 square meters. However, if there is a basement, then logically there will be at least one floor, so it is clear that the entire area of the building will be at least 550 square meters. In accordance with the requirements, if the building area exceeds 300 square meters, the developer must have prepared a full project, that must undergo examination, and also must have identified the contractor, that will perform the works and technical supervision.
Currently, employees of the Department of State Architectural Control of Uzhgorod City Council have prepared an order to suspend construction work. Also, under Article 39-1 of the Law of Ukraine "On regulation of urban development", the notification of commencement of the construction work was canceled. The documents have been submitted to the State Architectural Construction Inspectorate of Ukraine on deleting the notification of commencement of the construction work at Koshitska st., 21 from the Unified Register. All that, according to Oleksandra Zotova, means that the construction is unauthorized and illegal.
The Department of State Architectural Control of Uzhgorod City Council is considering imposing a fine on the owner of the building and is preparing a lawsuit regarding the demolition of the building.
