Regional parliamentarians do not agree with the use of Transcarpathian subsoil on the “tacit consent” basis

The control of the licensing system in the sphere of subsoil use is fully centralized in Kyiv and the role of local councils is reduced to formal decision-making

During the first plenary meeting of the third session of the Transcarpathian Regional Council, the deputies adopted an appeal to the Cabinet of Ministers of Ukraine on amendments to the Resolution of the Cabinet of Ministers of Ukraine of 16.12.2015 number 1173.

It says that, due to the entry into force of the Resolution of the Cabinet of Ministers of Ukraine of 16.12.2015 number 1173 "On amendments to some resolutions of the Cabinet of Ministers of Ukraine concerning the conformity with the essential requirements to the licensing system in economic activity", which introduced changes to the Resolution of the Cabinet of Ministers of Ukraine of 30.05.2011 number 615 "On approval of special licenses for subsoil use", licenses for subsoil use can be issued by the State Geology and Mineral Resources Service of Ukraine without any approval by respective regional councils if the same is not provided within the period prescribed for the license issue, that is on the "tacit consent" basis. Thus, now the control of the licensing system in the sphere of subsoil use is fully centralized in Kyiv and the role of local councils is reduced to formal decision-making.

 

 With this in mind, members of the Transcarpathian Regional Council appealed to take measures for suspension of and making amendments to the Resolution of the Cabinet of Ministers of Ukraine of 16.12.2015 number 1173 "On amendments to some resolutions of the Cabinet of Ministers of Ukraine concerning the conformity with the essential requirements to the licensing system in economic activity" and to grant local governments the authority to give permission for the use of natural resources.
