Lviv Court upheld the misuse of funds in the Main Department of Justice in the Transcarpathian region

In March 2011, the State Financial Inspection in Transcarpathian region audited financial activities of the Main Depatrment of Justice in the Transcarpathian region. As a result, on March 24, 2011, the Report on audit of certain aspects of financial activities of MDJ in Transcarpathian region № 07-08/19 was drawn up, which indicated a number of grave violations in use of public funds – including misuse thereof, breach of tender legislation, etc.

Part of the violations cited in the report of the State Financial Inspection concerned the activity of the previous department management, the other part – the period from June of 2010 when the MDJ in Transcarpathian region was headed by its current director Petro Ilnytsky.

MDJ in Transcarpathian region then appealed against the results of the audit in Transcarpathian District Administrative Court, which is March 23, 2012 partly allowed the claim. However, the State Financial Inspection in Transcarpathian region in turn appealed against the decision and October 18, 2012 a panel of judges of Lviv Administrative Court of Appeal by the relevant resolution "came to the conclusion on the legality of the audit findings regarding misuse of budget funds" in the Main Department of Justice in the Transcarpathian region. Accordingly, the court decided "to upheld the appeal of the State Financial Inspection in Transcarpathian region". 

Information about the violations committed by the management of MDJ in Transcarpathian region is still not in the public domain because, according to Zakarpattya online, the head of the Transcarpathian Regional State Administration Oleksandr Ledyda is trying to prevent publishing the results of the audit report and the decision of the Lviv court, scince he is related to the head of the department Petro Ilnytsky and personally lobbied his appointment to this position.

However, as it became known to Zakarpattya online, the Ministry of Justice of Ukraine reacted to the violations in the activities of its subordinate and filed a corresponding appeal with the Prosecutor General of Ukraine.
