Courts invalidated the decision of Uzhgorod City Council to grant ownership of at least five plots measuring 0.10 hectares, comprising the land of the military camp number 42, to private persons.
According to Zakarpattya online, it is evidenced, in particular, by the decision of the Commercial Court of the Transcarpathian region dd. July 30.
The Court found out that 29.12.2007 the district Uzhgorod withdrew the land in area of 1.33 hectares from the permanent use of the Armed Forces of Ukraine and transferred it to the reserve lands of the city. In April 2010, this land was divided into smaller plots in area of 0.1 hectares that were privatized by physical persons.
As the Court pointed out, the decision of the city council in 2007 was declared invalid by a court order in another case. Thus, due to invalidiity of the City Council decision on appropriation of plots from the Defense Ministry, as well as the fact that neither the Defense Ministry nor direct the user of the site – the Quartermaster Department – did not give consent for the appropriation of the land, the court upheld the claim of the prosecution.
Recall that in 2006, in a military camp number 42, they illegally desposed of 27 property items at Gagarin st., 28 in Uzhgorod, resulting in damage to the state in the amount of 17.68 million hryvnias. This was done by entering into an investment agreement on cooperation in the reconstruction of the camp facilities with the "Audit firm "Energo-Audit plus" LLC, which later became the property of the the firm. In 2011, this agreement was recognized as invalid by a court.
The owner of the "AF "Energo-Audit plus", as of 2006, was Larysa Sirenko from Kyiv, who in 2007 was replaced Victor Kolisnichenko.
