Moskal remains a deputy of the Transcarpathian Regional Council (+Document)

The National Agency of Ukraine on Civil Service gave official explanation on the application of Article 10 of the Law of Ukraine "On civil service" in terms of combining civil service with the status of a deputy of local council. As referred to in the explanation, Art. 22 of the Constitution Ukraine does not allow narrowing of the content and scope of existing rights and freedoms of a person and a citizen in the adoption of new laws or amendments to existing laws.

Since the constitutional rights and freedoms are guaranteed and can not be canceled, and considering Art. 58 of the Constitution of Ukraine concerning the irreversibility of laws and other legal acts, according to the National Agency of Ukraine on Civil Service, Art. 10 of the Law shall not apply to persons, who at the date of entry into force of the Law "On civil service" are deputies of local councils as a result of their election in accordance with the Law of Ukraine "On elections of deputies of local councils and village, town and city mayors," for the period established by the Constitution of Ukraine or until the early dissolution of local councils.

– I have to disappoint everyone who was looking forward to May 1 and planned to have me out of the Transcarpathian Regional Council – the head of the RSA Hennadiy Moskal said. – I continue to remain a deputy until the end of the regional council term.
