A Transcarpathian, who received funds from the state, but did not take care about his daughter, was deprived of parental right

The prosecutor’s office has made a man, who was receiving funds from the state and would not help his daughter, to be deprived of parental rights.

Under the prosecutors’ request, by the decision of Mukachevo district court, the child’s father, who would not help her, was deprived of parental rights.

Recently, prosecutors defended their position and by the ruling of the Court of Appeal in Transcarpathian region, the appeal of the father’s representative was dismissed.

In 2015, Mukachevo local prosecutor’s office came to the defense of interests of a minor resident of the city, who had been fully supported and brought up by her grandmother since 2011, despite the fact that her own father lived nearby.

 

During the hearing is was confirmed that the grandmother was taking care of and suppoting the girl on her own, without any outside help. Meanwhile, the father was receiving a survivor’s pension. However, not a single penny of that money had been spent on the child.

After establishing these facts in court, the prosecution started criminal proceedings under Part 1 of Art.164 of the Criminal Code of Ukraine (fraudulent evasion of payment of funds for the support of a child and evasion of parental obligations).

Disagreeing with the decision of the court, the father and his representative appealed the decision of the court of first instance. However, after examining the case file, having heard the arguments of the prosecutors and a representative of the guardianship and custody office, the panel of judges of the Court of Appeal in Transcarpathian region decided to dismiss the complaint and leave the decision of Mukachevo city and district court unchanged.
