The hearing about pre-trial restraint against representatives of the "Right Sector" lasted in Uzhgorod inter-district court all night.
They were detained at the resort Dragobrat because of a fight at one of the lodges.
The detainees look like people with serious beatings.
According to the department of the reception of citizens, consideration of appeals, requests and public relations of Transcarpathian regional prosecutor’s office, Uzhgorod interdistrict court, on the proposal of the prosecutor’s office, imposed a pre-trial restraint – detention for the period of two months – on two of the five participants of the fight at the "Dragobrat". As for the other three people, the hearing still continues.
According to the press service of Uzhgorod interdistrict court, hearings on pre-trial restraint for each of the suspects lasted for over fourteen hours.
As stated in the criminal case, these persons are suspected of committing a crime under Part 4 of Article 296 of the Criminal Code of Ukraine (hooliganism, that is a gross violation of public order on motives of explicit disrespect to community in a most outrageous or exceptionally cynical manner, by a group of people using firearms or knives or other objects specially adapted or prepared in advance for bodily injury).
During the consideration of the prosecutors’ requests, each of the suspects said that they needed medical assistance. The court, taking into account the opinion of all parties, granted the suspects’ request for a medical examination. Therefore, they were transported by an ambulance to a health institution.
However, the suspects were brought to the court again because, according to doctors, none of them needed hospitalization. However, they requested medical care again.
After hearing the request of the prosecution and the defense arguments, examining the evidence available in the materials of the criminal proceeding, the court decided to impose the strictest pre-trial restraint – detention – on suspects Vasyl Vasylynyuk and Petro Uhryn. Given that the alleged offense belongs to serious violent criminal acts, and given the fact that the suspects are inhabitants of other regions of Ukraine, the court decided to isolate the suspests from society for the duration of the preliminary investigation, without bail.
Meanwhile, lawyers of suspects Malkovich V, Tishchenko S. and Okorkov A. filed a motion for recusal of the judge. This motion is to be considered by other judges of Uzhgorod city and district court, and if it is granted, the request on pre-trial restraint regarding the above-mentioned persons will be considered by another investigating judge.
So, two suspects of hooligan actions with firearms will be held in custody for the period of pre-trial investigation until the 8th of March.
