The prosecutor audit conducted in Uzhgorod city council determined that the Department of Architecture and Urban Planning of Uzhgorod City Council issued "Zakarpatnaftoprodukt-Mukachevo" PJSC urban planning conditions and restrictions for the development of land at Shumna st., 22a.
However, as prosecutors found out, according to the Land Code of Ukraine, the said land belongs to the land for the residential and public buildings and not to transport land. Meanwhile, in accordance with Art. 71 of the Land Code of Ukraine, any land under gas stations belongs to transport land.
In addition, the construction of the gas station is not envisaged by the Master Plan of the city of Uzhgorod. Also, the city prosecutor’s office determined that the public hearing on the construction of a high risk facility – a gas station – had not been properly conducted. That is, public opinion was not taken into account.
In connection with the above mentioned violations of the law, prosecutors of Uzhgorod, in order to protect the interests of the state and the local community of the city, requested the Transcarpathian Regional Administrative Court to recognize the actions of the officials of the City Council on the issuance of urban planning conditions and restrictions on land development at Shumna st., 22A illegal and to cancel the permit for construction issued in November 2012.
At the same time, prosecutors of Uzhgorod appealed to the court requesting to prohibit "Zakarpatnaftoprodukt – Mukachevo" PJSC to build a filling station on Shumna street. Following the claim of the prosecutor of Uzhgorod, Transcarpathian Regional Administrative Court opened the proceeding on the said case, the results of which will be informed to the public.
