In the course of the plenary meeting of the 13th session of the regional council of the VІІ convocation, the regional deputies adopted an appeal regarding the regulation of the mechanism of customs clearance of cars with foreign registration addressed to the President, the Verkhovna Rada and the Government of Ukraine, the press service of the Transcarpathian Regional State Administration reported.
The document states that in order to prevent the growth of social discontent and protests, it is necessary to urgently regulate the procedure of customs clearance of cars with foreign registration regarding the adjustment of the customs value of vehicles.
"On November 25, 2018, the Laws of Ukraine "On Amendments to the Tax Code of Ukraine regarding the Taxation of Motor Vehicles" and "On Amendments to the Customs Code of Ukraine and Certain Legislative Acts of Ukraine Concerning the Importation of Vehicles into the Customs Territory of Ukraine" entered into force. Their purpose is to provide the opportunity to legalize the cars purchased abroad by means of customs clearance.
However, the amount of customs payments under the said laws, even taking into account the tax exemption, are high. And those owners of the said cars, who have found money for customs clearance, have to overcome obstacles illegally created by the customs bodies.
We, the deputies of the Transcarpathian Regional Council, in order to prevent the growth of social discontent and protests, ask the President of Ukraine, the Verkhovna Rada of Ukraine, the bodies of the central executive authorities to take measures to abolish the norms of the legislation, which, in essence, are discriminatory against the citizens of Ukraine and make the customs clearance of cars with foreign registration impossible, thus negating the efforts of legislative bodies aimed at legalizing cars with foreign registration.
We believe that the said laws do not contain a complete legal mechanism for the implementation of the proposed provisions, which will lead to conflicts of legislative norms and incomplete legal regulation of the relevant sphere of relations. Therefore, during the improvement of the legislation regulating the issue of customs clearance of cars with foreign registration, we ask to take into account the conclusions of the Main Scientific and Expert Board and the observations of the Main Legal Department to the draft Laws of Ukraine "On Amendments to the Tax Code of Ukraine regarding the Taxation of Motor Vehicles" and "On Amendments to the Customs Code of Ukraine and Certain Legislative Acts of Ukraine Concerning the Importation of Vehicles into the Customs Territory of Ukraine".
In this way, we call on the authorized bodies of executive power to provide an accessible, clear, transparent mechanism for customs clearance of cars with foreign registration", – it is stated in the appeal of the deputies.
