Prosecutors proved in court the illegality of the Uzhgorod City Council decision

By the ruling of the Transcarpathian Regional Administrative Court, the Uzhgorod prosecutor’s claim was upheld, and the decision of Uzhgorod City Council dd. December 2, 2013, on the appeal to the President of Ukraine regarding the resignation of the government was recognized unlawful and reversed.

According to the Prosecutor of Uzhgorod Ivan Shtefaniuk, "Uzhgorod City Council decided to send a petition to the President of Ukraine regarding the resignation of the government. This was a violation of the Law of Ukraine "On Local Self-Government", because, according to Art. 26 of the said law, the appeal on resignation of the government does not belong to the exclusive competence of local councils."

Also, by passing this decision, Uzhgorod City Council once again violated para. 3 of Art. 15 of the Law of Ukraine "On access to public information", according to which draft decisions of local authorities shall be published no later than 20 days prior to their consideration. Instead, not a single draft decision of the said session has been published.

Therefore, by the ruling of the Transcarpathian Regional Administrative Court, the Uzhgorod prosecutor’s claim was upheld, and the said decision of Uzhgorod City Council on the appeal to the President of Ukraine regarding the resignation of the government was recognized unlawful and reversed.
