Prosecutors do not agree with Pogorelov’s decision

In response to the information of uzhgorod.in about the actual reinstatement of the head of the urban planning complex and land resources department Leonid Samsonov, announced by Uzhgorod mayor, we received explanations from the press service of the regional prosecutor’s office.

 The official response of the prosecutor’s office: Considering that the official is reasonably suspected of having committed a serious criminal offense which entails criminal punishment in the form of imprisonment for a term of 5 to 10 years, in order to ensure that the suspect fulfills the procedural obligations imposed on him, and given the that he, while working as the deputy head of the urban planning complex of Uzhgorod city council, may interfere with the criminal proceedings, commit another criminal offense, the prosecution appealed to the court with a request to remove the suspected deputy head of the urban planning complex and land resources department of Uzhgorod City Council from his office for the duration of the pre-trial investigation.

Also, the prosecutors reminded that October 17, 2013, the regional prosecutor’s office served the deputy head of the urban planning complex and land resources department of Uzhgorod City Council S., who had been detained while obtaining undue advantage, a written notice of the suspicion of a criminal offense under Part 4. 368 of Criminal Code of Ukraine.

Then, as provided by law, at the request of the Prosecutor’s Office the court removed the official from the office for 2 months – from October 31, 2013 through December 31, 2013.

However, since in December, the official took a sick leave, the investigation was suspended. However, the suspect did not report on his recovery and ending of his sick leave.

Once the investigators became aware of the reinstatement of the suspect, the prosecutor’s office took immediate measures for his removal.
