A criminal proceeding for abuse of power has been initiated against the Mayor of Uzhgorod. On December 20, 2014, the information about the criminal offense was registered in the Unified register of pre-trial investigations.
This is stated in the documents, copies of which are available to the publication Zakarpattya online.
The pre-trial investigation is carried out by investigator of Uzhgorod city police department V.Kuzma, who gave response to the request by Natalia Maystrenko, who was the representative of Uzhgorod City Council in the administrative case 308/3199/14-A, in which Victor Pogorelov was reinstated as the mayor of Uzhgorod.
As previously reported, the ruling for "reinstatement" of Pogorelov was appealed in court by Uzhgorod City Council, but later V.Pogorelov by "verbal order" tried to withdraw this appeal, which was initiated by the current Secretary of Uzhgorod city council Bogdan Andriyiv, the First Deputy Mayor Ivan Voloshin and the administrator of the executive committee Daniela Gevorgyan.
As previously reported, on December 11, Natalia Maystrenko, who was the representative of Uzhgorod City Council in the case №308/3199/14-a, filed statements with prosecutors of Uzhgorod and Transcarpathian region. In her view, V.Pogorelov "wrongfully assumed powers of the mayor on November 26, 2014". In addition, as N.Maystrenko reported, according to the response of Uzhgorod City Council №463-03-23 of December 10, 2014, the appeal filed by her in this case on behalf of Uzhgorod City Council was withdrawn by verbal order of the Mayor V.Pogorelov.
"In those actions of Victor Pogorelov I see not only a conflict of interest within the meaning of the Law of Ukraine "On Prevention and Combating of Corruption", but also the signs of a crime under Article 364 of the Criminal Code of Ukraine", - N.Maystrenko noted.That is, in this case it is an abuse of power or position by V.Pogorelov. Accordingly, N.Maystrenko requested the prosecutors "to register the offense in the Unified register of pre-trial investigations, to start the pre-trial investigation..."
