Transcarpathian prosecutors exposed Lviv railway officials
Transcarpathian prosecutors exposed the officials of the "Lviv Railway" who unreasonably gave up the land, where a state building was situated, in favor of third parties.
The Prosecutor of the Transcarpathian region registered in the URPI the information on the abuse of authority or office by officials of the "Lviv Railway".
According to the chief of advocacy, anti-corruption and crime in the transport sector department of the regional prosecutor's office Oleg Popovich, "The prosecutor's office conducted the audit as part of supervision over the observance and application of laws at the "Lviv Railway" regarding violations of land and other laws of Ukraine."
"During the audit, it was established that officials of the "Lviv Railway", during 2006-2009, abusing official position, that is intentionally for the benefit of third parties, had unreasonably gave up the right to use the land in area of more than 1 hectare.
In addition, the state owned real property was located on this land. And the normative monetary evaluation of the land is more than 250,000 UAH.
Thus, by their actions, officials of the "Lviv Railway" caused grave consequences to the interests of the state.
Part 2 of Art. 364 of the Criminal Code of Ukraine - the abuse of power or position, that is intentional, for mercenary motives or other personal benefit or for the benefit of third parties, using official authority or official position contrary to the interests of the service, if it caused substantial harm to legally protected rights, freedoms and interests of individuals or state and public interests, or interests of legal persons - shall be punishable with imprisonment for a term of three to six years, with disqualification to hold certain posts or practice certain activities for up to three years with a fine of five hundred to one thousand times the minimum non-taxable income and with special forfeiture.
