Prosecutors defended orphaned brothers' property rights for an apartment

Mukachevo City and District Court recently upheld the regional prosecutors' claim for ​​protection of the right to inheritance - a parents' apartment - of the orphans: a 13-year-old and a 4-year-old boys.

"However, - the head of children's rights protection of Transcarpathian regional prosecutors office Olesya Bokoch said - despite the fact that one of them was under the care of his grandparents, and another one - in the regional orphanage, the issue of protection of their inheritance right had long remained unnoticed by the Service for Children and administration of the orphanage. Only in last December, the Service for Children in Mukachevo prepared statement of claim in the interests of only one of the brothers, and in the course of the examination, the prosecutor's office found out that there is another child who also has the right to the apartment."

"Often, children's rights are restored only after the intervention of the prosecution" - Olesya Bokoch said. "Thus, the prosecutor of Rakhiv District filed a statement of claim in the interests of an orphan V. to declare unlawful the ruling by a notary public who refused to issue a certificate of inheritance by law. At the same time, the prosecutor asked the court to oblige the notary to issue such certificate to the child. However, this fact for a long time had remained unattended by services for children of the district state administration and the authority."    


The causes of these violations are inadequate performance of their duties by officials of social services for families, children and youth and services for children of district state administrations and executive committees, lack of control over their activities by the management of the Transcarpathian Regional Center of Social Services for Families, Children and Youth, the Service for Children of the Regional State Administration. Therefore, based on the results of the inspection, the Prosecutor of the Transcarpathian region sent a submission to the RSA demanding to take measures to eliminate violations of the legislation, the causes and conditions that promoted them, to immediately restore the children's rights, and to discipline officers of the Services for Children and Social Services for Families, Children and Youth of Irshava and Uzhgorod District State Administrations and the Transcarpathian Regional State Administration, through the fault of whom the said violations were committed.
