Prosecutors are against impairment of the "Crown"

Uzhgorod Prosecutors filed with the court an objection to the reduction of the selling price for the "Crown". This was reported by the press service of the regional prosecutor's office. Below is the original message.

Prosecutors of Uzhgorod city joined the hearing on the claim of the "Hotel Project Consulting Ltd." against the Department of Municipal Economy of Uzhgorod City Council concerning the reduction of the selling price of the "Crown", which is being considered by the Commercial Court of Transcarpathian region.

In particular, the prosecution of Uzhgorod filed with the Commercial Court of Transcarpathia an objection to the said claim requesting to deny the claim because the Law of Ukraine "On privatization of small state-owned enterprises (small privatization)" does not provide for changes in the conditions of privatization, including changes in selling prices of an object after the auction.  

   Thus, according to the Art. 9 of the Law of Ukraine "On privatization of small state-owned enterprises (small privatization)," it is determined that the price of an object of privatization shall be established on the basis of the assessment. In addition, Art. 23 of the Law provides that the contract of sale shall include the final selling price of an object at an auction.    

    The "Hotel Project Consulting Ltd" does not have the ownership of the object because the sales contract is not concluded, and the results of the tender for the privatization of an object are being challenged by the Uzhgorod city prosecutor's office appealed in the Lviv Commercial Court of Appeal."

Recall, the Prosecutor's Office earlier this year challenged the decision of the Commercial Court on the legality of the disposition of the "Crown".
